LICENSE AGREEMENT
You should carefully read the following terms and conditions before using this software. Unless you have a seperate written license or registration agreement signed by Roger Lee Heath, your use of this software by you indicates your acceptance of this license agreement and warranty.
Registered and Unregistered Versions:
The Activator(tm) Client Free Browser and dialer connection system with InfoGrid(tm), without registered features, may be used and distributed in its UNALTERED form freely.
The UNALTERED Activator(tm) Client also is for free distribution to clients of the authorized fully registered user of the Activator(tm) Database Server (ACTDBSRV.EXE). No charges, fees, sales, or modifications to the client and the InfoGrid(tm) portal may be made without a paid license from R. Lee Heath. The Activator(tm) Client and InfoGrid(tm) are free software, however, they remains the property of R. Lee Heath and its use is governed by this License Agreement.
One registered copy of Activator(tm) Database Server may either be used by a single person or single business who uses the software personally on one computer or server only, for each registered or licensed registered server use license registration from R. Lee Heath. You agree, through the use of this software, to use only on one server or one client on one machine for each such individual license or machine registration from R.Lee Heath. You agree to use registered features only on each one machine for which a registration has been legally purchased from R. Lee Heath for that individual pc or machine. This software may not be used for any commercial and/or promotional purpose what-so-ever without a license or registration from R. Lee Heath.
Governing Law:
This agreement shall be governed by the laws of the State of Illinois and the United States of America.
Disclaimer of Warranty:
THIS SOFTWARE AND THE ACCOMPANYING FILES ARE SOLD "AS IS" AND WITHOUT WARRANTIES AS TO PERFORMANCE OF MERCHANTABILITY OR ANY OTHER WARRANTIES WHETHER EXPRESSED OR IMPLIED. Because of the various hardware and software environments into which Activator (tm) client and server may be put, NO WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE OR OPERATING SYSTEM IS OFFERED.
Good data processing procedure dictates that any program be thoroughly tested with non-critical data before relying on it.The user must assume the entire risk of using the program. ANY LIABILITY OF THE SELLER WILL BE LIMITED EXCLUSIVELY TO PRODUCT REPLACEMENT OR REFUND OF PURCHASE PRICE.
Registered Activator(tm) client performs filtering of web content and utilizes a secure database system to manage user's access and content. While this has been designed to be reasonably secure, no warranty as to the efficacy of this security or it's vulnerability to hacking is offered.
Evaluation and Registration:
Activator(tm) Database/Server is not free software. Subject to the terms above and below, you are hereby licensed to use this server software one time for evaluation purposes only without charge for a period of 10 days. If you use this software after the 10 day evaluation period a registration fee is required. Payments must be in US dollars drawn on a US bank, and should be sent to R. Lee Heath as outlined in a current,order form for the products. Current order forms and pricing may be changed by R. Lee Heath at any time without notice, but may be obtained by writing R. Lee Heath, 2555 Victor Avenue, Suite 602, Glenview, Illinois 60025-4866 USA or by visiting the website listed below.
The UNALTERED Activator(tm) browser client is free for use except for registered features as listed. These features may only be enabled through paid registration or license on an individual machine (computer) by machine basis. Use of one machine registration on more than one machine is a violation of this license.
Distribution:
Distribution of Activator(tm) by any one other than fully authorized distributors appointed by R. Lee Heath is not permitted with exception to the free unregistered UNALTERED client browser dialer.
The InfoGrid(tm) link system,including it's database, may only be installed and used with the Activator(tm) client only for local disk access. No alteration or substitution of the file 'control.htm' or any other InfoGrid(tm) files installed with each client may occur except under paid license by R. Lee Heath.The images and trademarks in InfoGrid(tm) remain property of R. Lee Heath and may not be redistributed except with the unaltered free browser client.
Year 2000 Compliance:
The Activator(tm) Database/Server and Client Browser are year 2000 compliant.
Enforcement:
Should it be found that user has violated this license agreement, user agrees to pay all legal fees and expenses to R. Lee Heath for the enforcement of this agreement.
This product uses patent pending licensed products from Jack McMorris or Zed Software.
